These Terms of Service govern your use of musq.co.za and purchases made from MŪSQ.

MŪSQ is operated by MUSQ (Pty) Ltd, a private company incorporated in South Africa. References to "MŪSQ", "we", "us" and "our" mean MUSQ (Pty) Ltd trading as MŪSQ.

By using the website or placing an order, you agree to these Terms and the policies incorporated into them. If you do not agree, do not use the website or submit an order.

Nothing in these Terms excludes or limits a consumer right that cannot lawfully be excluded, including rights under the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002 and the Protection of Personal Information Act 4 of 2013.

2. Eligibility and Customer Information

You must have legal capacity to enter into the transaction or act with the assistance or consent required by law.

You agree to provide complete and accurate order, delivery and contact information and to update us promptly if any information changes.

You are responsible for keeping any customer-account credentials confidential and for activity conducted through your account, except to the extent caused by our failure to use reasonable security measures.

3. Product Information

We take reasonable steps to describe and display products accurately.

Colours, textures and natural materials may appear different depending on lighting, screen settings and the individual product.

Natural wood and stone may vary in grain, shade, texture and appearance. These expected variations are part of the material and are not necessarily defects.

Scent perception, intensity and longevity vary between individuals and may be affected by vehicle size, airflow, climate, temperature, placement and use.

Nothing in this clause excludes rights where a product is defective, unsafe, materially different from its description or not reasonably fit for its intended purpose.

4. Availability

Products and variants are subject to availability. Adding an item to a cart does not reserve it.

If a product becomes unavailable after payment, we will notify you and offer a lawful remedy, which may include a refund or an agreed substitute.

We will not substitute a product without your consent.

5. Orders and Contract Formation

Submitting an order is an offer to purchase the selected products on these Terms.

Before submitting the order, you can review the transaction, correct mistakes and withdraw from checkout.

An automated acknowledgement confirms that we received the order; it does not necessarily mean that the order has been accepted.

An order is accepted when we confirm acceptance or dispatch the goods, whichever occurs first.

We may decline or cancel an order on reasonable grounds, including genuine pricing errors, suspected fraud, payment failure, stock unavailability or a legal restriction.

If we cancel after receiving payment, we will refund the amount due.

6. Prices and Payment

Prices are displayed in South African rand unless stated otherwise.

The product price, delivery charge, applicable taxes and other compulsory costs will be disclosed before you submit the order.

Payment must be made through a payment method offered at checkout.

Payment processing may be provided by an independent payment provider subject to its security and processing terms.

You confirm that you are authorised to use the payment method submitted.

7. Delivery

Delivery areas, charges, processing periods and estimates are set out in our Shipping Policy.

Goods remain at our risk until accepted by you or an authorised recipient at the agreed address, subject to applicable law.

Delivery dates are estimates unless expressly agreed as fixed.

We remain responsible for performing the order within the period required by law or the period expressly agreed with you.

8. Cancellations, Returns and Refunds

Cancellations, cooling-off rights, defective goods, returns and refunds are governed by our Returns and Refunds Policy and applicable law.

Where ECTA applies, eligible online transactions may be cancelled within seven days after receipt, subject to lawful exceptions and return costs.

Where goods fail to meet the quality standards required by the CPA within six months after delivery, the consumer may exercise the remedies provided by law.

9. Product Use and Safety

Products must be used, positioned and stored in accordance with instructions supplied with the product or published on the website.

Car fragrance products are not for ingestion.

Keep products and fragrance oils away from children and pets and avoid contact with eyes, skin, fabrics, dashboards, trim and other vehicle surfaces.

Extreme heat may affect fragrance oils and natural materials.

Inspect the product periodically. Stop using it and contact us if you notice leakage, excessive oil migration, damage or another condition that may create a risk.

You are responsible for damage caused by use contrary to clear instructions, deliberate misuse, unauthorised modification or failure to take reasonable care.

This does not exclude liability that the law places on a producer, importer, distributor or retailer for unsafe or defective goods.

10. Website Use

You may use the website only for lawful personal or commercial shopping purposes.

You must not:

  • Interfere with the website's operation or security.
  • Introduce malicious code.
  • Attempt unauthorised access to systems or customer information.
  • Use the website for fraud, impersonation or unlawful activity.
  • Copy, scrape or commercially exploit website content without permission, except where allowed by law.
  • Submit false, misleading, defamatory or infringing content.

We may restrict access where reasonably necessary to protect customers, the website or our legal rights.

11. Intellectual Property

The MŪSQ name, logos, branding, designs, photographs, product copy and website content are owned by or licensed to MUSQ (Pty) Ltd.

You may view and use the website for ordinary shopping purposes. No broader licence is granted.

12. Customer Content and Reviews

If you submit a review, photograph or other content, you confirm that you have the right to submit it and that it is truthful and lawful.

You grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce and adapt that content for operating and promoting MŪSQ, unless otherwise agreed.

We will not use personal images in advertising without any consent required by law.

We may remove content that is unlawful, fraudulent, abusive, irrelevant or infringes another person's rights.

13. Third-Party Services and Shopify

Our store is hosted by Shopify and may use independent payment, courier, analytics and communication providers.

The sale contract is between you and MUSQ (Pty) Ltd.

A third-party provider is responsible for its own independent services, but we remain responsible for obligations that applicable law places on us as the supplier.

Links to third-party websites are provided for convenience and do not make us responsible for their independent content or practices.

14. Privacy

Personal information is processed in accordance with our Privacy Policy and applicable law.

By submitting an order, you authorise the processing and sharing reasonably necessary to accept payment, prevent fraud, fulfil the order, arrange delivery, provide support and comply with legal obligations.

15. Warranties and Liability

We do not exclude any statutory warranty, right or liability that cannot lawfully be excluded.

To the fullest extent permitted by law, we are not liable for indirect or consequential loss that was not reasonably foreseeable and did not arise from our gross negligence, wilful misconduct, breach of a non-excludable statutory duty or an unsafe or defective product for which the law imposes liability.

Nothing in these Terms excludes liability for death, personal injury or property damage where exclusion is prohibited by law.

16. Events Outside Reasonable Control

We are not responsible for delay caused by events outside our reasonable control, provided that we take reasonable steps to reduce the effect, keep affected customers informed and provide any cancellation or refund remedy required by law.

17. Complaints and Disputes

Please first contact support@musq.co.za with your order number and a clear description of the issue.

We will attempt to resolve the complaint fairly and promptly.

Nothing prevents a consumer from approaching the National Consumer Commission, an applicable consumer-protection authority, an accredited dispute-resolution body or a competent court.

18. Governing Law

These Terms and transactions concluded through the website are governed by the laws of the Republic of South Africa.

South African courts and consumer-protection bodies with lawful jurisdiction may hear disputes.

This clause does not remove any jurisdiction or remedy granted to a consumer by law.

19. Changes

We may update these Terms for operational, security, legal or regulatory reasons.

The current version and effective date will be published on this page.

Changes do not retrospectively remove rights that arose under an accepted order.
